Nursing Home Residents Won’t Be Affected by Medi-Cal Budget Cuts

According to Elder Law attorney Gene L. Osofsky, of the law firm Osofsky & Osofsky, the fear factor is high among Californians that many of our Elders in nursing homes may be directly impacted by Medi-Cal budget cuts. While this isn’t true, for Elders not living in nursing homes the story might play out quite differently. July 28, 2009, was the day when embattled California Governor Arnold Schwarzenegger signed the new budget into law. “Like […]

The Life Insurance Exam Routine

To get life insurance there is a routine that has to be followed before one qualifies. It only makes sense that to obtain life insurance the company will want to know as much as possible about the person applying. Knowing as much as possible, of course, usually means a health exam done by a doctor or paramedic, lots of forms to fill out, the routine blood tests, urine tests and saliva tests, not to mention […]

Watch Out for the Big Rigs

18-wheelers do not have the ability to stop quickly and the consequences are often death for those in other vehicles. It’s a given that if a big rig crashes into another vehicle, the smaller of the two vehicles involved in the accident will bear the brunt of the damages. Big rigs weigh in at 40 tons or 80,000 pounds. The average car only weighs about 5,000 pounds. This is a bit like David versus Goliath. […]

Incorporating a Nevada Business

Setting up the right type of business entity in Nevada is crucial for a lot of good reasons. Just because someone had the bright idea to set up a business in Nevada doesn’t mean all the details can be immediately put into action and the business open within a month. While that might be a nice dream, the practical reality is that there are a lot of hoops one needs to go through to set […]

Wrongful Death Structured Settlements

Although many people seem to think a wrongful death action is a criminal case, it is not. A wrongful death action is a civil suit with the award called a structured settlement. Those who have experienced the loss of a loved one thanks to the actions of another individual or a company may file a wrongful death claim or lawsuit in civil court. Perhaps the best example of a potential wrongful death suit is the […]

Tripod Accident Settles for $1.35 Million

Stratton Faxon, Connecticut’s firm for trial law, helped to procure justice for a woman victimized by a defective tripod that had been manufactured by a Chinese company. It happened at a restaurant called Knickerbocker’s in Middletown, Connecticut, in December 2003. A disc jockey was setting up a lighting display for a show. An 80-pound lighting fixture on an adjustable tripod came out of its socket and landed on Angela Wilson’s head. She was briefly knocked […]

Health Care Twist-Uninsured Includes Illegal Aliens

Recently the President stated illegal immigrants would not get health care. The twist here is that the ranks of the uninsured already includes illegal aliens. In the mass of information, misinformation, disinformation and plain speculation over health care reform, the burning question remains what will happen to illegal immigrants yet to arrive in America and those that already live here? It’s a two pronged problem with seemingly very few comprehensive solutions. The biggest problem, however, […]

The Department of Homeland Security, the Money Pit

The House distinguished itself in a not so good way just recently when it managed to pass several counterproductive immigration reform amendments. The problem most of the members of the House have with the Department of Homeland Security(DHS) and their enforcement issues is why vote against those measures now when they may vote for comprehensive immigration reform later, which would include similar enforcement issues. That being said, someone should likely have kept a tab on […]
